How do I know for sure if a DVD is pirated

Yes, they are saying they aren't pirated. But they are. Of course, they will not admit to such a thing.
Either a release is licensed and you will find it on regular retail, or it is not like on that website.
There is no such thing as "international releases". Region 1 releases are either US or Canadian and if you do not find these releases in online stores like amazon.com/ca, the chances are high, that they are bootlegs.

This is really annoying, and I am going to send another note and ask where they bought them. They'll probably say something like they can't divulge the names of their suppliers. I don't even remember how I ran across that site, because I typically buy all my DVDs from a very small number of legitimate online retailers.

I so much appreciate everyone's help. Maybe my credit card company will go after them for the money. I'll post what the vendor response to the note if I get one.

Well, they say on their site:

"All episodes are recorded from TV and digitally converted to DVD. These are not studio-produced products like you would find in a store because they do not yet exist."

After that there are a few pages worth of explaining just why this isn't piratism, and why their practise is completedly legal. If someone would take them to the court about that, I wouldn't be betting for them.

Are they DVD-R's?  Purple on the underside rather than silver or gold?  That'd be a certain tipoff that they're bootlegs.  No major studio (and that includes 20th Century Fox, which owns X-Files) would be releasing a DVD-R.
